Terms and conditions
These terms and conditions, as may be amended from time to time, apply to all our services directly or indirectly (through distributors) made available online, through any mobile device, by email or by telephone. By accessing, browsing and using our website or any of our applications through whatever platform (hereafter collectively referred to as the "website") and/or by completing a reservation, you acknowledge and agree to have read, understood and agreed to the terms and conditions set out below (including the privacy statement).
These pages, the content and infrastructure of these pages, and the online hotel reservation service provided on these pages and through the website (the "service") are owned, operated and provided by Findmeahotelroom and are provided for your personal, non-commercial use only, subject to the terms and conditions set out below.
1. General
1.1 - This Contract is made between the Customer and the relevant hotel and not with Findmeahotelroom who are the Hotelier`s Agent.
1.2 - These Terms and Conditions shall be incorporated into all hotel reservation bookings no matter how the same are made, i.e. whether by telephone, e mail or otherwise.
1.3 - No variation or modification to the Terms and Conditions shall be valid unless evidenced in writing and signed by a duly authorised representative of findmeahotelroom.
1.4 - Findmeahotelroom warrants that it has authority to enter into this Agreement on behalf of the relevant Hotelier.
1.5 - The Customer acknowledges that this Agreement and these Terms and Conditions contain the whole agreement between the Client and the Hotelier and further that the Client has not relied upon any oral or written representations made by findmeahotelroom or its employees or agents.
1.6 - This Agreement supersedes any prior agreement between the Client and the Hotelier whether written or oral.
1.7 - In the event that any term or condition in this Agreement is declared by any judicial or any other competent authority to be void, avoidable, illegal or otherwise unenforceable the remaining provisions shall remain in full force and effect.
1.8 - This Agreement is governed by English Law in every particular including formation and interpretation and shall be deemed to have been made in England. Any proceedings arising out of or in connection with this agreement shall be brought in a Court within England or Wales.
1.9 - Headings contained in this Agreement are for reference purposes only and shall not be incorporated into this Agreement and shall not be deemed to be any indication of the meaning of the clause and sub clause to which they relate.
1.10 - It is the Client`s sole responsibility to check and ensure that all booking details are accurate and correct. Findmeahotelroom accepts no responsibility or liability for any discrepancies discovered subsequent to the booking being confirmed.
1.11 - Upon entering into this Agreement the Client consents to disclosure of information by findmeahotelroom to the Hotelier for the purposes of the Data Protection Act 1984 or subsequent enactments.
1.12 - All offers advertised on Findmeahotelroom or by its reservation staff are subject to availability, which varies from time to time.
1.13 - Any/all complaints relating to the nature or quality of the accommodation shall be made to the relevant Hotelier. In the event that the Client is not satisfied with the outcome of it`s complaint it should forward details to Findmeahotelroom, who whilst not being responsible or indeed liable for the same, will endeavour to facilitate an amicable resolution as between the Client and the Hotelier at its discretion.
1.14 - Findmeahotelroom acts as agent only. Each product (e.g. flight, hotel or car hire, etc) has its own price independent of any other products booked at the same time and creates a separate contract directly between you and the provider of that product. Travel bookings are ATOL & IATA protected.
2. Scope of Service
2.1 - Through the website Findmeahotelroom provide an online platform through which hotels (including all types of temporary accommodation) can advertise their rooms for reservations, and through which visitors to the website can make such reservations. By making a reservation through Findmeahotelroom, you enter into a direct (legally binding) contractual relationship with the hotel at which you book. From the point at which you make your reservation, we act solely as an intermediary between you and the hotel, transmitting the details of your reservation to the relevant hotel and sending you a confirmation email for and on behalf of the hotel.
2.2 - When rendering our services, the information that we disclose is based on the information provided to us by the hotels. As such, the hotels are given access to an extranet through which they are fully responsible for updating all rates, availability and other information which is displayed on our website. Although we will use reasonable skill and care in performing our services we will not verify if, and cannot guarantee that, all information is accurate, complete or correct, nor can we be held responsible for any errors (including manifest and typographical errors), any interruptions (whether due to any (temporary and/or partial) breakdown, repair, upgrade or maintenance of our website or otherwise), inaccurate, misleading or untrue information or non-delivery of information. Each hotel remains responsible at all times for the accuracy, completeness and correctness of the (descriptive) information (including the rates and availability) displayed on our website. Our website does not constitute and should not be regarded as a recommendation or endorsement of the quality, service level or rating of any hotel made available.
2.3 - Our services are made available for personal and non-commercial use only. Therefore, you are not allowed to re-sell, deep-link, use, copy, monitor (e.g. spider, scrape), display, download or reproduce any content or information, software, products or services available on our website for any commercial or competitive activity or purpose.
3. Disclaimer
3.1 - Findmeahotelroom does not make any representation or warranty as to the nature or standard of the hotel accommodation. The information contained within Findmeahotelroom and on its call centre database is provided for illustrative purposes and findmeahotelroom accepts no liability for any loss whatsoever or howsoever as a result of any errors or inaccuracies contained therein.
3.2 - Findmeahotelroom will endeavour to secure accommodation in a hotel specified by the Client but where there is no such availability Findmeahotelroom will use its best endeavours to provide accommodation in a similar hotel of a similar standard in the specified area but accepts no responsibility should no alternative accommodation be available.
3.3 - Whilst Findmeahotelroom will use its best endeavours to achieve the best rate for the Client during the period of its stay, Findmeahotelroom does not warrant and shall not be responsible in the event that better rates could have been obtained.
3.4 - Findmeahotelroom accepts no responsibility for any cancellation, alteration, curtailment or otherwise of any booking where performance is rendered impossible due to but not limited to an event of national emergency, war, prohibitive Governmental Regulation or any other cause beyond the control of Findmeahotelroom.
4. Payment and Pricing
4.1 - The Client agrees to make payment for the booking at such time and in such manner as shall be required by the Hotelier which will be notified to the Client by findmeahotelroom prior to confirmation of the booking.
4.2 - Failure by the Client to make payment at the time or in the manner required shall amount to a material and fundamental breach of this Agreement entitling the Hotelier to terminate forthwith without notice.
4.3 - In order to secure a booking the Client shall provide Findmeahotelroom with all relevant credit card information that findmeahotelroom may require in order for this to be forwarded to the Hotelier. ·
4.4 - The prices on our site are highly competitive. All prices on the Findmeahotelroom website are per room for your entire stay and are displayed including VAT and all other taxes (subject to change of such taxes), unless stated differently on our website or the confirmation email.
4.5 - Sometimes cheaper rates are available at our website for a specific stay at a hotel, however, these rates made by hotels may carry special restrictions and conditions, for example in respect to cancellation and refund. Please check the room and rate details thoroughly for any such conditions prior to making your reservation.
4.6 - The currency converter is for information purposes only and should not be relied upon as accurate and real time; actual rates may vary.
5. Free of charge
Our service is free of charge. Unlike many other parties, we will not charge you for our service or add any additional (reservation) fees to the room rate. We will not charge your credit card, as you will pay the hotel directly for your stay.
6. Cancellation
6.1 - The cancellation policy of each hotel may differ and therefore the policy which relates to each booking will be published on the website prior to the booking and the Client agrees to be bound by such.
6.2 - By making a reservation with a hotel, you accept and agree to the relevant cancellation and no-show policy of that hotel, and to any additional (delivery) terms and conditions of the hotel that may apply to your reservation or during your stay, including for services rendered and/or products offered by the hotel (the delivery terms and conditions of a hotel can be obtained with the relevant hotel). The general cancellation and no-show policy of each hotel is made available on our website at the hotel information pages, during the reservation procedure and in the confirmation email. Please note that certain rates or special offers are not eligible for cancellation or change. Please check the room details thoroughly for any such conditions prior to making your reservation.
6.3 - In the event that the Client wishes to cancel a booking it must notify findmeahotelroom via a telephone fax or e mail and in the event that the Client does not receive any response from findmeahotelroom within 24 hours, it is the client`s responsibility to contact findmeahotelroom regarding the same.
6.4 - The Client acknowledges that in the event of a cancellation taking place outside the Hotelier`s cancellation period, he will be responsible for the appropriate cancellation charges arising there from.
6.5 - Findmeahotelroom business hours are Monday to Friday 8.30 a.m. to 5.30 p.m. except on public bank holidays. If a Client wishes to cancel outside Findmeahotelroom`s normal business hours or carry out any amendments to an existing booking it must do so in those circumstances direct with the hotel and inform findmeahotelroom of such changes.
6.6 - In order to avoid any disputes resulting from amendments or cancellations made by you direct with the hotel it is essential that you ask for an amendment or cancellation reference number which you should communicate to findmeahotelroom immediately either by fax, email, text message or by telephone the next working day. ·
6.7 - If you wish to review, adjust or cancel your reservation, please revert to the confirmation email and follow the instructions therein. Please note that you may be charged for your cancellation in accordance with the hotel`s cancellation and no-show policy. We recommend that you read the cancellation and no-show policy of the hotel carefully prior to making your reservation.
7. Communications
7.1 - Telephone calls with Findmeahotelroom may be monitored or recorded.
7.2 - E mail correspondence between the client and Findmeahotelroom and any e mail booking request forms will be saved and may form part of this Agreement.
7.3 - Correspondence should be sent to Findmeahotelroom at Findmeahotelroom, DFC House, Boston Road, Gosberton, Spalding, Lincolnshire PE11 4NR. Communications by e mail should be addressed to hotels@Findmeahotelroom.co.uk. In order to contact us by telephone dial 01775 843414.
8. Force Majeure
Findmeahotelroom accepts no responsibility for the cancellation, alteration or curtailment of any booking made as a result of matters beyond reasonable control, including but not limited to acts of God, natural disaster, fire and any other destruction of any accommodation booked, riots, acts of war or civil commotion, exercise of legislative, municipal, military or other authority, strikes, industrial action or any other reason beyond the control of findmeahotelroom.
9 . Privacy
Findmeahotelroom uses high ethical standards and respects your privacy. Save for disclosures required by law in any relevant jurisdiction and the disclosure of your name, email address and your credit card details for completing your booking with the relevant hotel of your choice, we will not disclose your personal information to third parties without your consent. However, we reserve the right to disclose your personal information to our provider, employees and our trusted agents and representatives who have access to this information with our permission and who need to know or have access to this information to perform our service (including customer services and internal (audit/compliance) investigation) to and for the benefit of you. 10. Credit card
10.1 - Hotels require credit card details in order to guarantee your reservation. As such, we will send your credit card information directly to the hotel at which your booking is made and the hotel may verify (i.e. pre-authorise) your credit card as well. In order to safeguard and encrypt your credit card information when in transit to us, we use the "Secure Socket Layer (SSL)" technology for our services.
10.2 - For certain rates or special offers, please note that your credit card may be pre-authorised or charged (sometimes without any option for refund) upon reservation and confirmation of the booking. Please check the room details thoroughly for any such conditions prior to making your reservation.
11. Further correspondence
By completing a booking, you agree to receive (i) an email which we may send you shortly prior to your arrival date, giving you information on your destination relevant to your booking and destination, and (ii) an email which we may send to you promptly after your stay at the hotel inviting you to complete our guest review form. Other than the email confirmation providing for the confirmation of the booking, the guest review invitation and the emails for which you may have actively opted in, we shall not send you any further (solicited or unsolicited) notices, emails or correspondence, unless you specifically agree otherwise.
12. Ranking and Guest reviews
12.1 - The default setting of the ranking of hotels on our website is `Recommended` (or any similar wording) (the "Default Ranking"). For your convenience we also offer other ways to rank the hotel. Please note that the Default Ranking is created through a fully automatic ranking system (algorithm) and based on multiple criteria.
12.2 - The completed guest review may be (a) uploaded onto the relevant hotel`s information page on our website for the sole purpose of informing (future) customers of your opinion of the service (level) and quality of the hotel, and (b) (wholly or partly) used and placed by Findmeahotelroom at its sole discretion (e.g. for marketing, promotion or improvement of our service) on our website or such social media platforms, newsletters, special promotions, apps or other channels owned, hosted, used or controlled by Findmeahotelroom. We reserve the right to adjust, refuse or remove reviews at our sole discretion.
1.14 - Findmeahotelroom acts as agent only. Each product (e.g. flight, hotel or car hire, etc) has its own price independent of any other products booked at the same time and creates a separate contract directly between you and the provider of that product. Travel bookings are ATOL & IATA protected. The guest review form should be regarded as a survey and does not include any (further commercial) offers, invitations or incentives whatsoever.
13. Disclaimer
13.1 - Subject to the limitations set out in these terms and conditions and to the extent permitted by law, we shall only be liable for direct damages actually suffered, paid or incurred by you due to an attributable shortcoming of our obligations in respect to our services, up to an aggregate amount of the aggregate cost of your reservation as set out in the confirmation email (whether for one event or series of connected events).
13.2 - However and to the extent permitted by law, neither we nor any of our officers, directors, employees, representatives, subsidiaries, affiliated companies, distributors, affiliate (distribution) partners, licensees, agents or others involved in creating, sponsoring, promoting, or otherwise making available the site and its contents shall be liable for (i) any punitive, special, indirect or consequential loss or damages, any loss of production, loss of profit, loss of revenue, loss of contract, loss of or damage to goodwill or reputation, loss of claim, (ii) any inaccuracy relating to the (descriptive) information (including rates, availability and ratings) of the hotel as made available on our website, (iii) the services rendered or the products offered by the hotel, (iv) any (direct, indirect, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, pursuant to, arising out of or in connection with the use, inability to use or delay of our website, or (v) for any (personal) injury, death, property damage, or other (direct, indirect, special, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, whether due to (legal) acts, errors, breaches, (gross) negligence, wilful misconduct, omissions, non-performance, misrepresentations, tort or strict liability by or (wholly or partly) attributable to the hotel (its employees, directors, officers, agents, representatives or affiliated companies), including any (partial) cancellation, overbooking, strike, force majeure or any other event beyond our control.
14. Miscellaneous
14.1 - Unless stated otherwise, the software required for our services or available at or used by our website and the intellectual property rights (including the copyrights) of the contents and information of and material on our website are owned by Findmeahotelroom, its suppliers or providers.
14.2 - To the extent permitted by law, these terms and conditions and the provision of our services shall be governed by and construed in accordance with UK law and any dispute arising out of these general terms and conditions and our services shall exclusively be submitted to the competent courts in the UK.
14.3 - If any provision of these terms and conditions is or becomes invalid, unenforceable or non-binding, you shall remain bound by all other provisions hereof. In such event, such invalid provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and you will at least agree to accept a similar effect as the invalid, unenforceable or non-binding provision, given the contents and purpose of these terms and conditions.
